Added a rather odd – and perhaps misleading – case where the EAT seems to have said that for justification in an indirect discrimination claim, it was correct to assess not only the proportionality of the general policy applied by the employer, but also the proportionality of applying it to the individual claimant: Ministry of Defence v Brown & College of Policing.
