The Equality Act received Royal Assent on 8th April 2010 but is not yet in force. It will merge race, gender, disability discrimination etc into one piece of legislation. However, the Act also include major changes to disability discrimination law, such as a revised 'justification' defence and changes to the disability equality duty. More on Equality Act 2010...
The Government Equalities Office is consulting on revised draft guidance on the meaning of disability. The draft includes specific examples on stammering. More on 'meaning of disability' consultation...
Following a consultation document in November 2008, the Equality Act 2010 includes provisions to replace 'disability-related discrimination' with a new concept of 'discrimination arising from disability', and also 'indirect discrimination' as already used for sex discrimination etc. This aims to address the House of Lords decision in London Borough of Lewisham v Malcolm, which severely limited the scope to make a claim for less favourable treatment. The Government rejected proposals to have a purpose clause in the Equality Act, but has been consulting on the possibility of a Bill of Rights and Responsibilities including a constitutional equality provision. More on Constitutional equality provision...
