Case study

from page 148 DfEE Report on Monitoring the Disability Discrimination Act, 1995

(NB: this is an actual case but I don't know the name of it.)

An applicant with diabetes was dismissed from a driving job.

The industrial tribunal held that a special diet which effectively controlled the applicant's diabetes was "treatment" within Schedule 1 para 6 and could be disregarded accordingly. The applicant was therefore "disabled". However, the applicant lost on other grounds.
